OCTOBER 17, 2000

 

Webster Township Board Meeting called to order at 7:30 by Sup. Fisher. Present: Fisher, Baldus, Calhoun, Fink, Kingsley, Zoning Insp. Jim Ross, Deputy Kevin Hause, Attorney Mark Reading and six residents.

 

Motion Fink support Kingsley to approve Sept. 19, 2000 minutes as presented. Carried.

 

Motion Kingsley support Calhoun to adjourn to executive session with Attorney  Reading’s client privilege letter. Zoning Inspector Jim Ross to join board in closed session. Carried.

Closed session adjourned at 8:40.

Regular meeting reconvened at 8:45.

Motion Fink support Calhoun to move Mr. Bloom’s Special Use Permit be on the November Regular Meeting date or special meeting date called by the board. Carried.

 

Treasurers Report Received.

Motion Calhoun support Kingsley to accept treasurers report and pay bills as presented.

 

Motion Fink support Calhoun Webster Township Board acknowledge the request of Data Trace Division of First American Tax  Service and authorize the Treasurer to provide a monthly updated copy of the Webster Township Tax Roll, under the following conditions:

 

l. Data Trace will sign an affidavit warranting that Webster Township Tax Roll data will be used solely by entities of First American Tax Service for the express purpose of determining tax payment status, conducting title search work, deed preparation and use such information only as is pertinent to the sale or transfer of property title.

 

2. Data Trace will warrant that Webster Township Tax Roll data will not be sold or transferred to any commercial entity or private party outside of First American Tax Service for any purpose whatsoever. .

 

3. Data Trace will reimburse Webster Township at the rate of $25.00 per month for each month in which a disk containing an updated Webster Township Tax Roll is provided.

Webster Township Planning Commission Report Received.

 

Parks and Recreation Committee Report received. Four new trees have been ordered to replace the four that died.

 

Zoning Inspectors report received. Eleven permits issued between Sept. 19 and Oct. 17, 2000.

 

Sheriff report received.

 

Review and approval of agenda. Sup. Fisher said to strike item C, Budget adjustments.

A)    Eagle Scout Project.

Motion Kingsley support Calhoun to approve expenditure of $336.20 for Eagle Scout Project shared cost with Webster Historical Society. All ayes and carried.

A)    Designation of Jennings Road as Natural Beauty Road. Motion Kingsley support Calhoun to table action of Natural Beauty Road until after the Public Hearing October 23, 2000. Carried.

2)      The Resolution approving the transfer of the Cable Television Franchise read and discussed.

8)      Zoning Inspectors Report.                     

Seventeen permits were issued, nine for homes, four address’s and twenty one property inspections. A year ago at this time there were 201 permit s, 96 for houses. This year 184 permits, 68 for houses.

9)      Sheriff’s report presented by Deputy Hause.

10)   Motion Fink support Kingsley to accept agenda as presented. Carried.

A) Prochazka Consent Judgment.

.Motion Calhoun support Fink to table to December Meeting. Carried.

 B) Designation of Jennings Natural Beauty Road.

   No feedback received from Road Commission at this time.

C)    Thomas M. Bloom

A proposed Resolution (with accompanying Consent Judgment) to settle the Bloom matter was read by Sup. Fisher. This was followed by lengthy discussion and public input. This resolution died for lack of a motion.

 

Motion by Fink, support by Calhoun to deny Bloom’s request to withdraw petition for Special Use Permit and adopt the 5/17/2000 recommendation of Township Planning Commission to deny Thomas M. Bloom’s petition for a Special Use Permit.  AMENDMENT TO MOTION: Motion Fisher support Fink to amend the motion to instruct Township Attorney to enjoin Mr. Bloom from further dirt bike use at Mast Rd. Roll call vote: Ayes: Fisher, Baldus, Calhoun, Fink, Kingsley. Nays: None. Carried. 

                 

                  Motion Fink, support Calhoun to express to the Court the Township’s support

                  of intervention, in Township Suit, by Webster Citizens for Quality of Life.

Webster Township Board Meeting called to order Dec. 19,2000 by Sup. Fisher. Present: Fisher, Baldus, Calhoun, Fink, Kingsley, Deputy Hause

And six residents.

 

Presentation by representatives for AT&T on need for a 195’ cell phone tower near N. Territorial and Webster Church Roads. Numerous questions by members of the board  about use of existing towers including Edison Transmission line towers and any projected future requirements.

 

Motion Kingsley support Fink to accept minutes of Nov. 21, 2000 Public  Hearing and Regular Meeting as presented. Carried.

 

Motion Calhoun support Baldus to accept Treasurers Report and pay bills as presented. Roll call vote. All ayes and carried.

 

Report received from Webster Township Planning Special Meeting November 28, 2000.

 

No Parks and Recreation Report received.

 

Zoning Inspector issued 11 permits, 5 addresses and twelve property inspections.

Motion Kingsley support Calhoun to authorize Sup. and Clerk to execute documents necessary to complete purchase of 9.72 acres from May Mast Estate.  Roll Call Vote. All ayes and carried.

 

Prochazka Consent Judgment. Discussion between attorneys. Webster Township VS Thomas Bloom. No additional information. Leavitt VS Webster Township ZBA. No additional information. Designation of Jennings as Natural Road. Denied by Road Commission.

D)   Petition for Speed Limit Reduction on Chamberlin Road. Motion

Motion Calhoun support Baldus to accept Treasurers report and pay bills as presented. Roll call vote, all ayes and carried. Treasurer to check options for paying taxes with credit cards.

 

 

Webster Township Planning Commission will review the Master Plan and Section 4.11

The Special Ag. District, January 17,2001.

 

Parks and Recreation Comm. Reviewed consideration for possible enhancement of property, such as pathways and flowers.

 

Zoning Inspector issued 4 permits bringing total houses for this period to 70. One year ago 90.

B)     AT&T Cell Phone Tower site search continues after lengthy discussion. Motion Kingsley support Fink Township notify AT&T they need to prove they need the tower and Sup.Fisher to look for a potential consultant. Carried.

C)    MHP Meeting with Ernie Maddock and Lee Campbell with a lengthy discussion on a possible site for a Mobile Home Park.

D)    Parks and Recreation Board plan to come back to the board for budget considerations. Possibly a 6” well. Sup. Fisher to investigate feasibility and cost of 30,000 gallon buried reservoir

E)     Disposal of old Computer equipment:

Motion Kingsley support Fink to dispose of surplus Computer Equipment to other agencies as we see fit. Carried.

Concerns about recycling, process for adoption of 2 acres, how ordinances are implemented. Sup. Fisher explained relationship between Master Plan and Zoning Ordinance and the specific roles of the Planning Commission and Township Board. Webster Township Board Meeting called to order at 7:30 by Sup. Fisher. Present: Fisher, Baldus, Calhoun, Fink, Kingsley, Zoning Inspector Jim Ross, Mariah Howell and nine residents.

 

Motion Fink to accept 3/20/01 minutes, second by Calhoun to approve the minutes with the following corrections, the addition of “treasurers report and bills presented”. All ayes. Carried.

 

Motion Kingsley support Baldus to accept Treasurers report and pay bills as presented.

Carried.

 

Mariah Howell gave a report on Fund Balance Activity and the effort on acquiring a new accounting software program.

 

Chairman Kingsley gave brief report on the 3/21/01 and 4/03/01 Planning ///commission Meetings. Noted the change in starting times. Meetings will now start at 7:30.

 

No response received from the Edison Tree Grant application.

 

Zoning Inspector issued 14 permits, 3 addresses and nine properties were inspected.

 

Sheriff Report received.

 

Motion Fink support Calhoun to add to agenda Line F, Northfield Township Library Funding, Line G, Equipment Purchase of scanner and software. Carried.

A)    Road Projects. Sup. to meet next week for quote on Joy Rd Project and bring results to May Meeting.

B)     Township has received signed copy of sales agreement for 9.7 Acres purchased from the May Mast Estate.

D)    Webster Township vs. Thomas Bloom. Motion to Adjourn Discovery. Mr. Walsh and Mr. Reading are proceeding to request the court for an injunction to prevent motorbike operations until suit is settled.

F)     Recycling letter written requesting funds from county 2000 and to extend recycling indefinitely.

            D) Meeting starting times. Planning Commission and Township Board   

                 Meetings now to start at 7:30 P.M.

            E) Resolution on Sheriff’s General Fund Road Patrol.

                Motion Kingsley support Calhoun Sup. To prepare a Resolution to County  

                Comm. regarding loss of Sheriff Patrol and bring to May Meeting. Ayes:

                Supervisor to send proposed Library Service Agreement to Attorney Reading

I)       Whitney Wetland project. Land is heading back naturally to what it was. Road Commission has ability to bank wet lands in County.

C)    Disposal of old Copy Machine. Motion Kingsley support Fink to dispose of old copy machine. Carried.

E)      Resolution on Sheriff’s General Fund Road Patrol. Motion Fisher support Kingsley  move to adopt Township Resolution to County Commissioners regarding loss of Sheriff Patrol. Carried.

F)     Scully Road Lane. Webster Township will ask permission of landowners to place no trespassing signs at end of Scully Road and enforce no trespassing laws. Township will also request that landowners consider a locked gate to close the lane.

 

CORRESPONDENCE

Copy of Building Codes update; letter from J.J. Lewis regarding Disabled Sports. Motion Fink support Kingsley third week in May be Disabled Sport Week. Carried.

        WEBSTER TOWNSHIP BOARD REGULAR MEETING

                                                          June 19, 2001

 

Webster Township Board Meeting called to order at 7:30 by Sup. Fisher. Present: Fisher, Baldus, Calhoun, Kingsley, Zoning Inspector Jim Ross. Deputy Hause and 45 residents. Absent: Trustee Fink.

 

Motion Calhoun; support Kingsley to accept May 15, 200l minutes as presented and carried.

 

Motion Calhoun; support Kingsley to accept Treasurer’s report and pay bills as presented. Roll call vote. All ayes and carried.

 

Auditor presented Audit Report FY 2000.

Motion Kingsley; support Calhoun to accept Auditor Report as presented. Carried.

 

Rick Tuttle from Charter Communications updated the progress being made. Suggested we send something in writing to have our phone number removed from the bills.

 

Township Planning Committee report received.

 

Zoning Inspector report received. 68 single home permits issued so far this year. 83 single home permits the previous year.

 

Deputy Hause presented the Sheriff report.

 

Motion Kingsley; support Calhoun to accept agenda as amended. Item K to Old Business, Northfield Township Library, Item F to New Business, Pineau Private Road. Carried.

 

OLD BUSINESS

A)    Motion Kingsley, support Calhoun to remove moratorium on Cluster Development in Ag Zone Property and move forward. Carried.

B)     Conflict of Interest Policy. Conflict of Interest Policy adopted by Township Board and approved by Attorney.

C)    Scully Road Lane. Mystic Ridge Development. Discussion on ownership of lane, installing a gate and no trespassing signs and a traffic count.

D)    FY 2001 Road Projects. Contract has been signed and first application of chloride applied.

E)     Purchase of 9.72 acres from May Mast Estate. Motion Fisher support Calhoun to approve terms of land contract for the purchase of 9.72 acre parcel from May A. Mast Trust. Roll call: Fisher, aye; Baldus, aye; Calhoun, aye; Kingsley, aye, Fink, absent and carried.

F)     Prochazka Consent Judgment. Multi family dwelling resolved.

G)    Webster Township VS Thomas Bloom. Bloom restrained from operating dirt bikes until completion of lawsuit. When property is sold all evidence of tract to be removed and land restored.

H)    Leavitt VS Webster Township ZBA. Court transcript back to ZBA. They need to strengthen their findings for granting variance.

I)       Recycling. Received payment from County for last 2 quarters of 2000 and first two quarters of 2001. Motion Kingsley, support Calhoun to terminate recycling July 31,2001. Carried. Signs to be put up and notice to be put in Dexter Leader.

J)       Whitney Wetland Project. No further notice from Drain Comm. for tapping drains.

K)    Northfield Township Library. Township will contact lawyer.

 

AUDIENCE PARTICIPATION

 

Request received to present bird count program at both the Regular Township and Planning Commission July meeting, question if Township interested in developing good sound wetland ordinance and do we really need another Cell Tower in Webster?

 

NEW BUSINESS;

A)    Nextel Cell Phone Tower. Awaiting further contact from Nextel.

B)     Sheriff Contract 2002. Have applied for state grant-want two deputies starting 01/01/02. Motion Fisher support Baldus beginning January 1,2002 to have two deputies. Roll call vote, all ayes and carried. Fink, absent.

C)    Budget revision. Motion Kingsley support Calhoun to approve amendment adjustments (restore $1,500.00 to Parks & Rec. line item 707). All ayes and carried. Motion Fisher; support Calhoun to approve budget adjustments as amended. Carried.

D)    Compliance Policy for ADA Requests for Accommodation. Motion Calhoun; support Kingsley to table until July meeting so Attorney Reading may prepare proper verbiage. Carried.

E)     Revision to Fee Schedule. Motion Fisher, support Kingsley to table until July Meeting. Carried.

F)     Pineau Private Road Permit. Motion Kingsley, support Calhoun to approve Private Road Application to curve contingent on review of Dexter Fire Dept. Carried.

 

Motion Calhoun, support Kingsley meeting adjourn at 10:45 and carried.
